3-Year Workmanship Warranty Policy

Landmark Basements Inc. stands behind the quality of its workmanship. Subject to the terms, conditions, limitations, and exclusions below, eligible workmanship performed by Landmark Basements Inc. or its authorized trades is covered by our 3-Year Workmanship Warranty.

This is a workmanship warranty. It is not a guarantee against every issue, condition, product failure, or change that may occur at the property after completion.

1. Warranty Period

The warranty period is three (3) years from the date of substantial completion of the applicable project.

For purposes of this warranty, “substantial completion” means that the contracted work has been completed to the point that the completed area can reasonably be used for its intended purpose.

Minor deficiencies, adjustments, touch-ups, incomplete warranty items, or cosmetic items do not delay the start of the warranty period.

The warranty period does not restart or extend when warranty work is performed, unless otherwise required by applicable law.

2. Final Payment Required

Coverage under this voluntary 3-Year Workmanship Warranty becomes effective only after the client’s final invoice and all other amounts properly owing to Landmark Basements Inc. under the applicable project agreement have been paid in full.

If amounts properly due and payable remain outstanding, voluntary warranty service may be suspended until the account has been paid in full.

Payment of an invoice does not prevent a client from submitting a legitimate warranty claim.

Nothing in this section limits any legal right or remedy that cannot be excluded, restricted, or waived under applicable Alberta law.

3. What the Warranty Covers

The warranty covers defects that are determined to have resulted directly from defective workmanship performed by Landmark Basements Inc. or its authorized trades as part of the agreed written scope of work.

If Landmark Basements Inc. determines that a claim is covered by this warranty, we will, at our option and within a reasonable timeframe:

  • Repair the affected workmanship;
  • Correct the affected workmanship; or
  • Replace the affected portion where repair or correction is not reasonably practical.

Our responsibility under this voluntary warranty is limited to the affected work that is determined to be defective, subject to applicable law.

4. Right to Inspect and Correct

Landmark Basements Inc. must be given a reasonable opportunity to inspect, investigate, and correct any alleged warranty issue before another contractor or third party performs repairs, modifications, removal, or replacement of the affected work.

The client must provide reasonable access to the property and affected areas for inspection and, where applicable, warranty repairs.

Except where immediate action is reasonably necessary to protect people or property from an emergency, the client should not authorize another party to alter or repair the affected work before Landmark Basements Inc. has had an opportunity to inspect it.

Landmark Basements Inc. is not responsible for third-party contractor fees, inspection fees, consultant fees, labour, materials, or other expenses incurred without our prior written authorization, except where otherwise required by applicable law.

Work altered, repaired, damaged, removed, or modified by another person may no longer qualify for warranty coverage to the extent that the third-party work caused, contributed to, concealed, changed, or prevents reasonable assessment of the claimed condition.

5. Client Responsibility to Report Problems

Clients must notify Landmark Basements Inc. of a potential warranty issue promptly after discovering it and before the applicable three-year warranty period expires.

The client must take reasonable steps to prevent an identified issue from becoming worse.

Landmark Basements Inc. is not responsible under this voluntary warranty for additional damage that results from an unreasonable failure to notify us of a known issue, continued use where continued use would reasonably worsen the damage, or failure to take reasonable steps to protect the property.

6. What Is Not Covered

The 3-Year Workmanship Warranty does not cover an issue unless it was directly caused by defective workmanship performed by Landmark Basements Inc. or its authorized trades.

Without limiting the above, the warranty does not cover:

  • Normal wear and tear, aging, fading, staining, discoloration, shrinkage, minor cracking, or ordinary deterioration;
  • Damage caused by misuse, abuse, negligence, accidents, improper use, or inadequate maintenance;
  • Damage caused by homeowners, occupants, tenants, guests, pets, movers, contractors, tradespeople, or other third parties;
  • Damage caused by furniture, equipment, appliances, fixtures, installations, or items added after completion;
  • Repairs, alterations, additions, modifications, or work performed by another contractor or person where that work caused or contributed to the issue;
  • Pre-existing defects, deficiencies, damage, or conditions;
  • Hidden or concealed conditions that were not reasonably visible or discoverable when the contracted work was performed;
  • Defects or deficiencies in existing construction outside our contracted scope of work;
  • Structural movement, settlement, shifting, vibration, expansion, contraction, deflection, or movement of the existing building, foundation, framing, concrete, or other existing components, unless directly caused by our covered workmanship;
  • Foundation cracks, movement, settlement, groundwater conditions, drainage issues, or existing structural conditions unless the particular issue is proven to have been directly caused by our covered workmanship;
  • Water penetration, groundwater, flooding, sewer backup, plumbing leaks, roof leaks, exterior building-envelope failures, condensation, excessive humidity, moisture, mould, mildew, rot, or similar conditions unless directly caused by covered workmanship performed by us;
  • Damage resulting from inadequate heating, ventilation, air circulation, humidity control, or environmental conditions outside our reasonable control;
  • Problems resulting from existing plumbing, electrical, HVAC, drainage, sewer, utility, structural, or mechanical systems outside our contracted scope;
  • Fire, flood, storms, freezing, severe weather, natural events, accidents, vandalism, pests, rodents, insects, or circumstances outside our reasonable control;
  • Damage or deficiencies caused by government authorities, utility providers, neighbouring properties, property managers, condominium corporations, third parties, or other circumstances outside our control;
  • Changes to building codes, regulations, bylaws, industry standards, or manufacturer requirements that occur after the work has been completed;
  • Product or material failures caused by manufacturing defects rather than installation workmanship;
  • Products, fixtures, equipment, appliances, finishes, or materials supplied by the client;
  • Product characteristics or natural variations in wood, stone, tile, concrete, grout, paint, flooring, cabinetry, or other materials that are not caused by defective workmanship;
  • Discontinued products, colours, finishes, textures, patterns, or materials where an exact match is no longer commercially available;
  • Damage resulting from failure to follow manufacturer instructions or reasonable maintenance requirements;
  • Damage resulting from excessive loads, improper mounting, drilling, cutting, fastening, or alterations performed after completion;
  • Damage resulting from work that was specifically excluded from the original written scope of work;
  • Conditions that arise from information, instructions, specifications, selections, or materials supplied by the client where Landmark Basements Inc. reasonably relied upon that information; or
  • Any condition that cannot reasonably be attributed to defective workmanship performed by Landmark Basements Inc. or its authorized trades.

7. Materials and Manufacturer Warranties

Our 3-Year Workmanship Warranty covers workmanship, not independent manufacturing defects.

Products, equipment, fixtures, appliances, flooring, cabinetry, plumbing fixtures, electrical devices, mechanical equipment, and other materials may have their own warranties provided by their respective manufacturers or suppliers.

The length and terms of a manufacturer’s warranty may be different from the Landmark Basements Inc. workmanship warranty.

Where appropriate, Landmark Basements Inc. may assist with information reasonably required for a manufacturer warranty claim; however, approval, replacement, reimbursement, shipping, labour coverage, and all other remedies under a manufacturer warranty are determined by the manufacturer or supplier.

8. Client-Supplied or Client-Selected Products

Landmark Basements Inc. is not responsible for the quality, suitability, compatibility, durability, performance, availability, or manufacturing defects of materials, fixtures, products, or equipment supplied by the client.

Where the client specifically selects a particular product or material, Landmark Basements Inc. does not guarantee the manufacturer’s performance or durability of that product.

Where applicable, our warranty remains limited to our workmanship in installing the product.

9. Maintenance and Environmental Conditions

The client is responsible for reasonable care and maintenance of the completed work and property.

The client is also responsible for maintaining reasonable interior temperature, ventilation, humidity, and moisture conditions appropriate for the materials and finishes installed.

Damage caused or materially worsened by improper maintenance, excessive humidity, excessive dryness, moisture, condensation, temperature conditions, or failure to address a known problem is not covered by this warranty to the extent those circumstances caused or contributed to the damage.

10. Cosmetic and Matching Limitations

Construction materials and finishes can naturally change in colour, appearance, texture, sheen, or tone over time.

If an approved warranty repair requires replacement of a portion of a material or finish, Landmark Basements Inc. will make reasonable efforts to achieve an appropriate match.

However, we cannot guarantee an exact colour, grain, texture, pattern, sheen, dye-lot, or finish match, particularly where products have aged, changed, or been discontinued.

A reasonable difference in appearance between repaired and existing unaffected materials does not require replacement of otherwise satisfactory unaffected work, except where otherwise required by law.

11. Permits and Inspections

Where permits or inspections are applicable to a project, approval or inspection by a municipality, authority, inspector, engineer, or other third party does not expand or alter the terms of this warranty.

Likewise, the existence of a permit or successful inspection does not make Landmark Basements Inc. responsible for pre-existing conditions or work outside our agreed scope.

12. How to Submit a Warranty Claim

Warranty claims should be submitted to Landmark Basements Inc. in writing.

Please provide:

  • Client’s full name;
  • Project address;
  • Project or invoice information, if available;
  • Approximate project completion date;
  • A clear description of the issue;
  • The approximate date the issue was first noticed;
  • Photographs or video of the affected area, where reasonably available; and
  • Any other information reasonably necessary for us to assess the claim.

Submission of a warranty request does not automatically establish that the issue is covered.

Landmark Basements Inc. may inspect and investigate the affected area to reasonably determine the cause of the condition and whether it falls within this warranty.

13. Approved Warranty Repairs

If a claim is approved, Landmark Basements Inc. will determine an appropriate method of repair or correction based on the nature of the covered workmanship issue.

Landmark Basements Inc. must be given reasonable access and a reasonable opportunity to perform the approved repair.

A client’s refusal to provide reasonable access or allow an approved corrective repair may affect Landmark Basements Inc.’s ability to provide further voluntary warranty service for that particular issue.

14. No Cash Value

This workmanship warranty is primarily a repair or correction warranty.

Unless Landmark Basements Inc. agrees otherwise in writing or applicable law requires another remedy, an approved warranty claim does not entitle the client to demand a cash payment, refund, discount, replacement of unaffected work, or payment to another contractor instead of allowing Landmark Basements Inc. a reasonable opportunity to correct the covered issue.

15. Additional or Consequential Losses

To the fullest extent permitted by applicable law, this voluntary warranty does not provide compensation for indirect or consequential expenses or losses that are separate from the repair of the covered workmanship, including temporary accommodation, inconvenience, loss of use, lost income, storage, moving expenses, or third-party professional fees.

This limitation does not apply where such a limitation is prohibited by applicable law.

16. Transferability

Unless Landmark Basements Inc. agrees otherwise in writing or applicable law requires otherwise, this voluntary 3-Year Workmanship Warranty is provided to the client named in the applicable project agreement and does not automatically transfer to a subsequent owner of the property.

17. No Expansion by Verbal Statements

The terms of this written warranty policy govern Landmark Basements Inc.’s voluntary 3-Year Workmanship Warranty.

No employee, salesperson, subcontractor, trade, representative, or other person may expand or modify this warranty through a verbal statement unless the change is confirmed in writing by an authorized representative of Landmark Basements Inc.

18. Applicable Law

This warranty is intended to operate in accordance with the laws applicable in the Province of Alberta.

Nothing in this warranty is intended to exclude, restrict, waive, or replace any statutory rights, warranties, remedies, or consumer protections that cannot lawfully be excluded, restricted, waived, or replaced.

If any provision of this voluntary warranty is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
